Article 1 — Purpose and scope

These Terms and Conditions of Sale govern all sales concluded between Rubience (hereinafter "the Seller") and any consumer or professional (hereinafter "the Buyer") placing an order via rubience.com or any associated platform.

Placing an order implies full and unconditional acceptance of these Terms. The Seller reserves the right to modify them at any time; the applicable Terms are those in force at the date of the order.

Article 2 — Seller identification

Rubience is a commercial brand headquartered in France. For any enquiry, the Buyer may contact customer service at: rubience.contact@gmail.com.

Intra-community VAT number available upon request.

Article 3 — Products and prices

Products offered for sale are described as accurately as possible. Photographs and visuals are for illustrative purposes only and are not contractually binding. The Seller reserves the right to modify its offerings at any time.

Prices are shown in euros inclusive of all taxes (VAT included) and exclusive of delivery charges unless otherwise stated. In the event of an obvious pricing error, the Seller reserves the right to cancel the order after informing the Buyer.

Promotions and special offers are valid only while stocks last and for the period indicated.

Article 4 — Order and acceptance

The order is confirmed upon receipt of full payment. The Seller sends an order confirmation by email within 24 hours (business days). This confirmation serves as an acknowledgement of receipt but does not constitute a definitive acceptance in the event of out-of-stock or unavailability.

The Seller reserves the right to refuse any order where an ongoing dispute exists with the Buyer or in the event of non-payment of a previous order.

Article 5 — Payment

Payment is due immediately upon ordering. Accepted payment methods are: credit/debit card (Visa, Mastercard, American Express), PayPal, Apple Pay and Google Pay. All transactions are secured by 256-bit SSL encryption.

In the event of fraudulent or unauthorised payment, the Seller reserves the right to cancel the order and inform the relevant authorities.

Article 6 — Delivery

Orders are dispatched within 24 to 48 hours (business days) after payment confirmation. Estimated delivery times are as follows:

  • Metropolitan France: 4 to 7 business days
  • Belgium, Switzerland, Luxembourg: 7 to 14 business days

Delivery is free in metropolitan France for all orders. A tracking number is sent by email as soon as the order ships. The Seller cannot be held responsible for delays attributable to the carrier or to force majeure events.

Article 7 — Right of withdrawal

In accordance with applicable consumer protection legislation, the Buyer has 30 days from receipt of the product to exercise their right of withdrawal, without having to provide reasons or pay any penalty.

To exercise this right, the Buyer must notify their decision by email to rubience.contact@gmail.com before the deadline expires. The product must be returned in its original packaging, in perfect condition, unused or used in accordance with its normal purpose.

A full refund, including initial delivery costs, will be processed within 5 to 10 business days after receipt and inspection of the returned product.

Article 8 — Legal warranties

All products benefit from statutory warranties applicable under French and European consumer law, including the warranty of conformity and the warranty against hidden defects.

In addition to statutory warranties, Rubience offers a 12-month commercial warranty covering all manufacturing defects. In the event of a malfunction, the Seller undertakes to replace or refund the device following examination of the claim.

Article 9 — Liability

The Seller shall not be held liable for indirect damages resulting from the use or inability to use the products. Rubience devices are wellness devices and do not constitute medical devices within the regulatory meaning; they do not replace medical advice.

In the case of a pre-existing medical condition, the Buyer is advised to consult a healthcare professional before use.

Article 10 — Personal data protection

Personal data collected during the order (name, address, email, payment information) is used exclusively for the processing and tracking of the order. It is neither sold nor transferred to third parties, except where legally required or necessary for order fulfilment (carrier, payment provider).

In accordance with the General Data Protection Regulation (GDPR), the Buyer has the right to access, rectify, delete and port their data by contacting: rubience.contact@gmail.com.

Article 11 — Disputes and governing law

These Terms are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the Buyer may use the European online dispute resolution platform (https://ec.europa.eu/consumers/odr).

If no amicable resolution is reached, the French courts shall have sole jurisdiction.
